By accessing or using our website, ordering food online, submitting a feedback form, or signing up for our SMS or email programs, you confirm you are at least 13 years old and agree to be bound by these terms and our Privacy Policy. If you do not agree, please do not use the site.

• Online ordering is processed by our point-of-sale partner Toast. Their terms apply to payment processing.
• Menu items, pricing, availability, and promotions are subject to change without notice.
• Catering orders may require advance notice. We will confirm timing and pricing before accepting your order.
• Gift cards are non-refundable, may not be redeemed for cash (except where required by law), and expire per applicable state regulations.

Our kitchen processes wheat, eggs, soy, and other common allergens. While we take reasonable precautions, we cannot guarantee any item is free of cross-contact. If you have a serious food allergy, please call us before ordering.

The Mike's Chicken name, rooster logo, slogans, photos, menu copy, and site design are owned by Mike's Chicken or its licensors and protected by trademark and copyright law. You may not copy, reproduce, or use them for commercial purposes without written permission.

When you use our forms, SMS conversations, or email programs you agree not to:

• Submit false, abusive, threatening, or unlawful content.
• Attempt to overwhelm our messaging or feedback systems (spam, scripted submissions, fake numbers).
• Impersonate another person.
• Use the site to violate any applicable law.

We may block, remove, or report any user that violates these rules.

Marketing texts are strictly opt-in. We send promotional text messages (such as special offers and Wait-Time Giveaway alerts) only if you separately choose to receive them. There are three ways to opt in and every one of them is optional: ticking the marketing box on our sign-up page at mikeschicken.com/sms, texting JOIN to our advertised opt-in number, or ticking the unchecked-by-default SMS marketing box in the online-ordering checkout operated by our ordering provider, Toast. Consent to marketing texts is not a condition of purchasing from us or using any of our services, and declining has no effect on your order or your access to the site.

The terms below govern every one of those paths, including the checkout box, which is displayed by Toast rather than by us: message frequency varies, message and data rates may apply, and you can reply STOP at any time to stop the messages.

Separately, if you provide your phone number when placing an order or submitting a form, we may send non-promotional, service-related messages about that specific interaction — such as order and feedback follow-ups and gift-card or prize notifications.

The site links to or relies on third-party services (Toast for ordering, Google for maps and analytics, Twilio for SMS, Resend for email). We are not responsible for the content, availability, or privacy practices of those third parties.

The site and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Mike's Chicken and its owners, employees, and partners are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the site or our services — including delivery delays, third-party platform outages, or losses caused by content you submit. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 30 days before the claim, or (b) $50.

You agree to defend, indemnify, and hold harmless Mike's Chicken from any claims, damages, or expenses (including reasonable legal fees) arising out of your violation of these terms or your misuse of the site.

We may suspend or terminate your access to the site or our messaging programs at any time, without notice, if we believe you have violated these terms.

These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Ocean County, New Jersey, and you consent to the personal jurisdiction of those courts.

We may update these terms from time to time. Material changes will be announced on the site. Your continued use of the site after changes are posted means you accept the updated terms.
